Hence, due to such complications, the judgments enforced to violations of environmental laws lies in the hands of juries, courts and prosecutors.
This identity crisis has hindered efforts from states the such U.S in adopting directive judgment policies for violation of environmental laws (David, 2000). Advocates who advocate for strict legal penalties disagree that companies do not suffer heavy penalties to compel them to adhere to environmental laws (Lavany, 2006). Other advocates oppose the declarations saying that, several defiances to environmental law have been inappropriately criminalized, and that the judgments are illogical and impulsive. This increased violation of environmental laws of continued disagreements. The persons who violate environmental law are fined a relatively low, for instance, an average of $10,181 in 1995 (Michael, 2003).
Practice and economic codes evidently disagree to a given extent; however, it is not revelation once one realizes pollution regulatory policies naturally brings conflicting ethical, economic competence and political allusions. All these environmental laws are managed under cover of doubtful scientific researches.
